Service Agreement

We are pleased to offer your good self and your pet(s) our service(s) upon the following terms and conditions:

Service Package 

1. We will provide all our services in accordance with our latest information booklet and your instructions, as more particularly provided in the Booking Form we received from you earlier.

2. We reserve all the rights to amend, modify, or revise the contents of the service package. In this regard, please refer to our information (website), which may be updated from time to time without prior notice. Despite the aforementioned, the updated information booklets will not have a retrospective effect.

3. You acknowledge and confirm that you have read and understood our latest information, which introduces and explains all of our services and potential risks. 

House Rules 

4. You acknowledge and confirm that you have read and understood our latest house rules, which you and your pet(s) would be subject to during having our service(s). You agree that the house rules would bind you and your pet(s).

5. We reserve all the rights to amend, modify, and revise the contents of the house rules. In this regard, please refer to our house rules, which may be updated from time to time without prior notice. Despite the aforementioned, the updated house rules will not have a retrospective effect.

6. You acknowledge and agree that we have absolute discretion to terminate this agreement if you and/or your pet(s) breach any terms of the house rules. In this event, you will be required, inter alia, to collect your pet(s) and leave our premises immediately, etc, whereas all the payments made to us will not be refunded. Upon the termination of this agreement, under no circumstance shall we have any further responsibilities to you and / or your pet(s). We would also reserve all the rights to claim against you for all the damages caused to us by your and/or your pet(s)’ breach (es) of the house rules.

Liability

7. You acknowledge and agree that you will be solely responsible for all of your and/or your pet(s)’ act(s), behaviour (s), and sickness(es) during the course of having our service(s). You further agree that you will indemnify us on all our damages outgoings disbursements, legal costs arising from all of your and/or your pet(s)’ act(s) and behaviour (s) sickness(es) (save and except that our negligence causes the same).

8. You acknowledge and agree that you have assumed all risk of illness, disease, harm, or injury whatsoever to you and / or your pet(s) during the course of having our service(s) (in particular those listed in our information booklet) (save and except that our negligence causes the same). You further agree that our liability shall, in no circumstance, exceed the sum of HK$2,000.00 per pet.

9. In the event you have special additional instructions requirements for us which are out of the service package (you acknowledge and agree that we have absolute discretion to refuse such special additional instructions requirements), you acknowledge and agree that we shall under no circumstance have any liability about those special additional instructions requirements (save and except that our negligence causes the same).

10. You acknowledge and agree that you are responsible for monitoring your properties when you / your pet(s) are using our service(s). You further agree that under no circumstance shall we be held liable for loss and damages to your properties (save and except that our negligence causes the same). 

Payment 

11. You acknowledge and agree that you will pay in accordance with the price schedule and payment method stipulated in the information booklet and house rules, respectively. 50% of our charges shall be settled upon making a reservation of our service(s), and the rest of our charges shall be settled immediately before your and/or your pets’ usage of our service(s).

12. You acknowledge and agree that, in any event, all payments made to us cannot be refunded save that if a cancellation of reservation of our service(s) is sought 14 days before the scheduled service(s) date(s), you can then spend the reservation payment in House of Kasey within 30 days upon the cancellation. In contrast, when the 30-day period expires, the reservation payment will be forfeited immediately without further notice.

13. Without prejudice to the forging, you further agree that under no circumstance, refund can be made or clause 11 can be applicable. The booked service cannot be rescheduled.

14. If you choose to settle our charges by issuing cheque(s) to us, if the said cheque(s) cannot be honoured at its stipulated time and if our charges cannot be settled by means other than issuing cheque(s) on or before the usage of our services, you acknowledge and agree that without prejudice to our rights to recover the outstanding charges, you would have to pay us an additional administrative HK$150.00 fee.

Additional Service(s) arrangement

15. You acknowledge and agree that we have absolute discretion to accept or not additional service(s) to be ordered during our service(s). Suppose additional service order(s) is/are received by us. In that case, you acknowledge and agree that the terms and conditions regarding the additional service(s) shall be the same as in this agreement, whereas you and your pet(s) shall also be subject to them.

16. You acknowledge and agree that an extension of the home accommodation service due to weather issues would also be considered an additional service.

17. If additional service(s) is added to the original service(s) package, you acknowledge and agree that all our outstanding charges shall be settled as soon as possible, but in any event, no later than the service(s) are finished. You further acknowledge and agree that save as having the right to recover the outstanding charges, we also have the undisputable right to withhold your pet(s) and send the same to relevant government bodies for their disposal if our charges are not settled as herein stated.

Contingency

18. You acknowledge and agree that we are not veterinarians and, therefore, are not expected to diagnose, detect, observe, or provide treatment against illness, disease or harm whatsoever suffered by your pet(s) during having our service(s) (save as except simple treatments pill feeding, eye drop, ear drop, etc. as previously instructed by you). However, if we observe the same, we will only immediately report to you and await further instructions.

19. If we cannot contact you or other persons as previously instructed by you by all means within 2 hours (in emergency 2 hours limitation would be changed to 5 minutes) after we observe that your pet(s) is /are suffering from illness disease or harm whatsoever during having our service(s), you hereby, grant an absolute discretion to us allowing us to take appropriate actions including but not limited to engaging veterinarians to provide necessary treatment(s) to your pet(s). In this event, you will be solely responsible for all the costs incurred thereon. In contrast, we will not be held liable for all the actions taken (except those taken negligently).

Warranty 

20. You acknowledge and confirm that all the information provided to us, whether in writing or orally, is accurate and true. You acknowledge and agree that we shall not be held liable for all losses arising from whatsoever due to inaccurate or wrong information provided by you.

21. You acknowledge and confirm that you are the sole owner of the pet(s) and that the ownership is free and clear of all liens, charges, or encumbrances whatsoever.

Miscellaneous

22. You acknowledge and agree to execute a departure/delivery form after you and/or pet(s) finish our service(s). The departure form shall be returned to us within a reasonable time for our office records.

23. You acknowledge and agree that if your pet(s) are not picked up by you or other persons as previously instructed by you immediately after our service(s) (or termination of this agreement), we have absolute discretion to send the same to relevant government bodies for their disposal without further notice.

24. You acknowledge and agree that we have absolute discretion to terminate this agreement if you and/or your pet(s) breach any terms herein. In this event, you will be required, inter alia, to collect your pet(s) and leave our premises immediately, etc, whereas all the payments made to us will not be refunded. Upon the termination of this agreement, we shall not have any further responsibilities to you and / or your pet(s). We would also reserve all the rights to claim against you for all the damages caused to us by your and/or your pet(s)’ breach (es) of this agreement.

25. You acknowledge and agree that we shall not be liable for i) failure to perform our obligations as stipulated in this agreement; ii) losses and damages to you and/or your pet(s) if such failure/losses and damages are as a result of Acts of God (including fire, flood, earthquake, storm, rainstorm, typhoon, hurricane or another natural disaster), war, invasion, the act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service, in which event we undertake that we would take all reasonable steps to minimize the losses and damages.
